Tips to Avoid a DUI Arrest

I want to give you some good advice on how you can best minimize the chances of being arrested for driving under the influence of alcohol or drugs, commonly referred to as DUI or Driving While Intoxicated.

There is no guaranteed method or trick to insure you will not be arrested for a criminal offense involving drugs, alcohol and driving. As a criminal defense attorney for 46 years now, I have talked to thousands of people who have been arrested for various offenses that involve substances and liquids that can cause you to become inebriated, high, loaded or whatever you would like to call the euphoric effect that people seek to escape reality. I have recorded in my mind the circumstances surrounding their individual and collective arrests and used that information to come to various conclusions that I will share with you here to try to help you from becoming a victim of the criminal justice system.

First, remember that if you are ever arrested for any criminal offense (and yes, DUI is considered a criminal offense), there is no substitute to having the best local criminal attorney that you can find and afford to help you avoid the possible charging and conviction of that criminal offense.

Can you avoid being arrested for an alcohol or drug related driving offense?  There is no sure fire way to avoid arrest. Of course, not drinking any alcohol or ingesting any drugs before you driving a motor vehicle is the best way to possibly avoid arrest. But even that is not a guarantee. There are countless cases of police arresting someone for DUI when the person arrested has had no drugs or alcohol in his blood system.

How can this be, you ask?

Well some cops are just bad at their job and don’t care one way or another about what happens to you. The cop may be mistaken, may be an unkind ass or just wants to add to his or her arrest statistics.

A police officer is supposed to have probable cause or a strong suspicion that a criminal act is occurring when they stop or detain someone for driving under the influence of alcohol or drugs.

Most cops will point to bad driving by the arrested person as their reason for a stop and detention, which then may lead to an arrest. You must drive as safely and as appropriately as possible when you are behind the wheel of a moving vehicle on a public or private roadway or any surface, private or public. (Yes, you can be arrested for DUI while driving a golf cart on a golf course or riding a bicycle on a bike path!)

So, keep your eyes on the road and drive as straight and steady as you can while driving at a speed that is as close to the speed limit as you can be. All California Highway Patrol vehicles are supposed to be equipped with mobile vehicle recording devices that will show you were driving straight and not hitting the lines with your tires if that is the case. So don’t give them a reason to stop you with bad driving

As one of the best DUI attorneys in the area, I always advise people not to have any items like rosaries or fuzzy dice hanging from their rearview mirrors and to not drive around with a cracked windshield. The police can stop you for one of these items or conditions obstructing your view out of the front windshield. This is a violation of the California Vehicle Code and the cop will use it to make the stop to investigate whether you may be under the influence of some substance that may be affecting your ability to safely drive the vehicle you are in.

Tinted windows are another favorite made-up reason to stop someone. Yes, here in the desert everyone gets their windows tinted, don’t they? No! I don’t because as an experienced local attorney I do not want to give the police any made-up reason to stop me and investigate my state of sobriety.

So you should heed the above to minimize your chances of arrest by minimizing the reasons a cop may have to stop you. Most of them are lazy. Be proactive by doing what’s right. If you are driving right, not drawing attention to you or your vehicle with any extra hanging items between you and your windshield, including cracks, and you don’t have tinted windows, you just may avoid the hassles of beating a case that never will occur. What is the difference between a state and federal criminal defense attorney?

This is a question that many people who are charged with a crime may ask themselves.

It is a valid question because there are many similarities between criminal law and charges that apply to both types of cases.

Many of the criminal charges that can be brought in a federal court or a state court can involve drug crimes, allegations of domestic violence and can result in jail time.

But the consequences of a charge in the two different courts are very different and could involve a different type of criminal defense attorney to represent you in the particular court.

Whichever court you are charged in, you want an experienced criminal defense attorney for that type of court.

As we have stressed several times in previous articles written for your benefit and enlightenment, when you look for an attorney to represent you in a case after your arrest for whatever alleged crime, look for an attorney who is experienced with the type of case that you have and a defense attorney who is familiar with the court that you have been ordered to appear in.

At the Jimenez Law offices we work exclusively in the Indio courthouse which only deals with state court charges. We are experienced and knowledgeable in defending state law cases. If someone comes to us with a federal case, we refer them to someone that we know is similarly experienced in federal court as we are in state court. The nearest federal court is in Riverside. There are no federal courts in the Coachella Valley. You can still get arrested in the Coachella Valley for a federal offense. But you will be sent to court in Riversde or even Los Angeles.

What are state offenses as opposed to federal offense?

The State of California has certain laws that are contained in the state statutes enacted by the state legislature and signed into law by the state governor. Most of these laws are contained in the state’s Penal Code, Vehicle Code, Health and Safety Code and Welfare and Institutions Code. A few criminal laws are also in the Fish and Game Code and Business and Professions Code.

Federal criminal laws are enacted by congress and signed into law by the President of the United States. Many of the types of criminal activity that one can commit can be charged either as a state offense or a federal offense depending on the severity of the offense and what the federal prosecutors decide that they want to do with it. These are crimes such as drug offenses involving large amounts, bank robbery and kidnapping.

Is the punishment different in state and federal court?

Yes, it is.

We don’t want to tell you anymore than that a federal case can generally carry a longer prison sentence than a similar state case. You should consult a federal defense attorney for more specific advice. Be aware that there is a sentencing scheme set up in federal court that the judges have to follow. This is as opposed to state cases where a judge may have more discretion in sentencing. Federal prisons may be easier for people to do their time in (Martha Stewart and others). But no one wants to do any jail time. And that is why we fight it so vigorously!

REMEMBER!

Whether you think you may be committing a state offense or a federal crime, you still have all of the rights of the U.S. Constitution protecting you! You should still remain silent before AND after arrest. You should NOT consent to a search of your person, property or vehicle. Don’t snitch anyone else off. And do NOT ever think the cop is your friend!

What’s with all the fake driver’s licenses?

First of all, is it driver’s license or drivers license? If you are reading our blog, you probably don’t care. But we are going to educate you a little, anyway!

“A driver’s license is a license that belongs to a driver. A driver license is a license to drive. You’d expect the adjectival form of the word to say what is being licensed, such as a dog, a marriage, hunting, a gun, or a driver (or driving.) Wikipedia”

So if you understood all that, then you may be able to help us out with the question we posed in the caption.

Why has there been an increase in the number of people being cited/arrested for possessing a fake driver’s license?

We believe that the answer can be found in what is generally happening in our state and country right now. People are more inclined nowadays to refuse to take responsibility for their own actions. They want to blame someone else for anything and everything bad that may be going on around them.

From fake or false statements being made to the press/media, to fake or false body parts. Our society is losing its sense of true identity and honesty. No wonder many young people are trying to find their fake identity in a fake driver’s license.

Not only will it allow them entry into an event or location where they may not otherwise be old enough to enter, but it may also allow them to buy alcohol or medicinal drugs that they may not otherwise be old enough to lawfully purchase.

What many people possessing fake identification do not understand is that the legal consequences can be significant. Misdemeanor possession of a fake ID may be punished by jail time, probation and/or a fine. And, if you are caught with a fake ID in California you may also have your driver’s license revoked for up to a year. If you are not yet old enough to have your driver’s license, or have not yet received it for another reason, you may be required to wait an additional year to obtain it.

But it won’t be exactly the same. And each courthouse in each county can vary in what they do to determine how they go about proceeding with the case of someone who has been arrested for a DUI. So how a DUI case is handled in the Indio Courthouse of Riverside County will be different from how a DUI case may be handled in the Banning Courthouse of Riverside County. So if you were arrested for a DUI in a geographic area where you have been ordered to appear in the Indio Courthouse, then you want a DUI attorney that regularly practices in the Indio Courthouse.

Is driving under the influence of marijuana considered a DUI?

Yes, one of the many changes in the DUI laws over the past couple of years was to make sure that marijuana and other types of drugs are specifically included as a DUI. If a police officer arrests you because he believes that any drug, prescribed, off the street or over the counter, has impaired your ability to drive safely, it is a DUI arrest. The DMV may not get directly involved in a DUI drug case like they do with a DUI alcohol case, but the court case will proceed in the same way whether it is alcohol or drugs.

Sex, Alcohol and Government Money!

We have recently noticed an increase in arrests by law enforcement of men who are seeking the companionship of a woman by use of the internet. Just last week it was reported that several men were entrapped through the use of online advertising method to go to a La Quinta hotel or similar location to meet a woman to spend some personal social time together. This is all being done in the name of the government’s fight to end so-called human trafficking in the Coachella Valley…although there is no such human trafficking occurring here!

False Arrests
